User agreement 

1. Scope and subject matter

1.1. This User agreement applies to the use of the Alumni portal “myalumni.unibe.ch” of the Alumni UniBE Office, Hochschulstrasse 6, 3012 Bern (here in after referred to as Alumni UniBE), by students and alumni of the University of Bern as well as by representatives of companies (here in after referred to as Users).

1.2. By using the Alumni portal, these terms and conditions are expressly deemed to have been agreed.

2. Services provided by Alumni UniBE

2.1. Alumni UniBE offers Users access to the password-protected online platform (“myalumni.unibe.ch”), which contains profiles, a job vacancy and company portal as well as an event management system with a modern search function.

2.2.  Users can use the Alumni portal as an online network and communication platform. Articles, posts and topics can be published in different groups. The purpose of the Alumni portal and its communities (groups) is to facilitate cross-disciplinary and cross-faculty exchange and networking as well as access to relationships and experiences of high professional and emotional value.

2.3. Alumni UniBE reserves the right to change and expand the content and structure of the Alumni portal if this does not impair the fulfillment of purpose or only to an insignificant extent.

2.4. Alumni UniBE is entitled to suspend access to the digital services of the Alumni portal for good cause, such as service and maintenance work, for a reasonable period of time.

3. Conditions of use

3.1. In order to receive services on the Alumni portal, Users must be registered on the Alumni portal and have created a profile. There is no legal entitlement to have the profile activated by Alumni UniBE.
 
3.2. Membership in the relevant community is a prerequisite for using the groups. There is no legal entitlement to activation or participation in a specific community.

4. Obligations of Users

4.1. Users are obliged to provide truthful information.

4.2.Users must keep their access data (user name, password and similar) secret and not pass them on to third parties. In the event of loss of access data or suspicion of use by an unauthorized person, Users are obliged to notify Alumni UniBE immediately so that access can be blocked as soon as possible.


4.3. The services and templates offered in the Alumni portal may only be used for the User’s own purposes and personal use. The transfer of data and information to third parties, whether paid or free of charge, is not permitted.

4.4.Users undertake to only store, publish, transmit and distribute content including photos, images, text, illustrations or videos that they are authorized to share, and not to copy, distribute and transmit accessible data without the express consent of the respective rights holder or to extract such data using technical aids. Users shall refrain from using trademark-protected words and iInternet addresses as user names (nicknames). The Weisungen über die Benutzung der IT-Ressourcen an der Universität Bern and Weisungen zum Datenschutz im IT-Bereich der Universität Bern must be observed in connection with this User agreement.

4.5.  In particular, Users are prohibited from publishing offensive or untrue content, from sending spam to other Users via the system, from carrying out anti-competitive activities, from posting a topic several times in the groups (ban on double posting), from publishing press articles of third parties in the groups without the author’s consent and from carrying out advertising in the groups without the express written consent of the provider. This also applies to so-called surreptitious advertising such as, in particular, the linking of your own homepage with or without additional text in the signature or within posts. Homepage URLs and address/contact details may only be published in the user profile of the groups.

4.6. Users are prohibited from interfering with the Alumni UniBE network using technical or electronic aids, in particular hacking attempts, the introduction of viruses/worms/Trojans and other attempts to disrupt the University’s software and hardware.

4.7. In the event of a breach of the aforementioned obligations, Alumni UniBE may also impose the following sanctions on Users, irrespective of termination: Deleting or modifying content posted by Users, issuing a warning or blocking access to the communities (groups). Access to the groups may be blocked if there is a reasonable suspicion that the Users concerned are violating these Terms of Use. Users can avert these measures if they dispel the suspicion by providing suitable evidence at their own expense. Alumni UniBE reserves the right to take legal action, e.g., compensation for damages caused by Users, etc.

5. Rights of use

5.1 By agreeing to this User agreement, you expressly acknowledge that the Alumni portal of the University of Bern contains information, text, software, images, videos, graphics, sound and other materials that are protected by property and intellectual property law (e.g., by means of copyright, trademark or patent protection). You also acknowledge that you are only acquiring non-exclusive rights of use and no ownership rights to the materials on the Alumni portal.

5.2 As a basic principle, the use of information and materials is subject to the federal and cantonal laws on intellectual property rights and data protection. Users shall be held personally responsible if they upload copyrighted works to the Alumni portal of the University of Bern and make them available to third parties.

6. Liability and warranty

6.1. Alumni UniBE makes every effort to make the Alumni portal available for access with as few disruptions as possible. Claims for damages due to a failure of the Alumni portal or the inability to retrieve individual user content or other disruptions to service are excluded, insofar as these are not attributable to Alumni UniBE due to intent or gross negligence. Liability for lost profits, missing savings, lost or altered data, indirect damages as well as damages arising from third-party claims is also excluded, unless required by mandatory law.

6.2. Alumni UniBE is not liable for damages caused by misuse or incorrect use of the data provided, by incomplete or incorrect information or by Users’ failure to comply with the due diligence obligations set out in the User agreement. Liability for damages resulting from third parties gaining knowledge of the username and password due to a lack of due diligence on the part of the user is also excluded.

6.3. Neither Alumni UniBE nor third parties guarantee in any way the accuracy, timeliness, performance,
completeness or suitability of the information and materials found or offered on the Alumni portal for a particular purpose. In particular, Alumni UniBE assumes no liability whatsoever for the accuracy of posts published in the groups. Users acknowledge that such content, information and materials may contain inaccuracies or errors. Any liability deriving from this is expressly excluded to the extent permitted by law.

6.4. Alumni UniBE also does not guarantee that the Alumni portal and its server are free of computer viruses or other harmful mechanisms.


6.5. The links used on the Alumni portal are intended for further information. They do not mean that the linked pages are supported by Alumni UniBE and Alumni UniBE is not responsible for their content.
